Terms and Conditions Summary

The Summer Raffle is operated by Alabaré (reg charity no 1006504) and registered address Riverside House, 2 Watt Road, Salisbury SP2 7UD. Small Society Lottery Number:      LN/000021366 (Wiltshire Council)

Purpose

The purpose of the Summer Raffle is to raise funds for Alabaré. The money will be paid into the Alabaré bank account and used to help fund the work of Alabaré.

The person responsible for the promotion of the Summer Raffle 2024 is Andrew Lord, Riverside House, 2 Watt Road, Salisbury SP2 7UD.

Rules

  1. Tickets cost £1 each. Minimum online purchase 5 tickets for £5.
  2. Raffle is open to anyone 18 or over.
  3. Tickets will be available through Alabaré’s website (alabare.co.uk) and physical tickets will be available through Alabaré staff, volunteers and Alabaré shops.
  4. Tickets will be sold through June, July and August 2024. Last date for purchase is midnight on Saturday 31st Applications for tickets received after that date won’t be entered into the Summer Raffle 2024 and the payment for such Raffle tickets will be treated as a donation to Alabaré.
  5. The Raffle prizes have been kindly donated to Alabaré and are: £1,000 (first prize), £100 (second prize) and 3 x £50 (third prizes).
  6. All physical ticket stubs to be returned to Fundraising at Riverside House, 2 Watt Road, Salisbury SP2 7UD by Saturday 7th
  7. The draw will be made by random selection on Monday 16th
  8. Winners will be notified within two days of the draw and will receive their prize by BACS within five working days of receipt of bank details.
  9. The names of the winners will be posted in the Alabaré team newsletter and on our website.
  10. If a winner cannot be contacted, their winnings will be added to Alabaré funds after six months.
  11. The Summer Raffle will be run by the Fundraising team. In case of any dispute, the decision of the Chief Executive is final. Complaints or disputes will be first handled by our Fundraising team with a right to appeal to the Independent Betting Arbitration Service.
Alabaré Terms and Conditions in full:

1. To be eligible to purchase a Raffle Ticket, you must:

Be 18 years of age or over;

Be located in Great Britain;

Comply with these terms and conditions.

2. A Raffle Ticket will be entered into the Summer Raffle 2024 if:

An application for such Raffle Ticket is received by us before the closing date and

Payment for such application is received by us before the closing date.

3. Each Raffle Ticket will be sold for £1.

4. We may, at our sole discretion, refuse to sell a Raffle Ticket to any person without giving reasons.

5. A Raffle Ticket may not be transferred from a person listed as the owner of the respective Raffle Ticket on our records to another person.

6. We’ll process your personal data securely to manage your entry into the Raffle. We’ll also use your data to send you information about how your purchase is helping to fund our work at Alabaré and future opportunities to be involved. Should you change your mind about whether to receive that information from us or how you’re contacted by us for marketing purposes, let us know by emailing us supportercare@alabare.co.uk. 7. Personal data provided to Alabaré as part of this raffle is held on a confidential basis. Such data will be used for raffle administration and auditing purposes. We will also use it to keep you informed of Alabaré’s activities (as in Clause 6). Except where necessary for our trusted suppliers to administer the raffle, your data will not be passed onto any third party. 8. Underage Purchases

By purchasing a Raffle Ticket, you confirm that you’re 18 years or older at the date when you purchased the Raffle Ticket. If we determine that a Ticket Holder is under the age of 18 at the date the Raffle Ticket was purchased, the Ticket Holder won’t be entitled to any Prize and we’ll return to the Ticket Holder the amount paid by them for the Raffle Ticket(s).

We reserve the right to verify the age of any person seeking to purchase a Raffle Ticket or a Ticket Holder, at any time (including after a Raffle Ticket has been purchased), by requesting such proof of age as we may require.

9. Payment

By purchasing, or attempting to purchase a Raffle Ticket, you agree to be bound by these terms and conditions.

Payment by post: payment for a Raffle Ticket can be made by cheque, or by credit or debit card. Charities Aid Foundation vouchers or other charity vouchers cannot be accepted as payment for Raffle Tickets.

Online payments must be made via our online raffle provider People’s Fundraising.  This is a third-party website, and by purchasing a ticket you will be subject to their terms and conditions which are outside of Alabaré’s control.  Tickets must not be purchased online using a credit card.

We accept no responsibility if the chosen method of payment is cancelled by you, your bank, or credit or debit card provider.

10. Postal entries

For postal entries, Raffle Ticket stubs must be completed and sent to Alabaré Summer Raffle, Riverside House, 2 Watt Road, Salisbury, Wiltshire SP2 7UD with the relevant payment by Saturday 7th September.

No responsibility is taken for any Raffle Ticket or payment which is lost, delayed, or damaged in the post. Proof of posting won’t be accepted as proof of receipt.

11. Closing Date for the Summer Raffle 2024 is 23.59 on 31st August 2024.

Applications for Raffle Tickets received after the Closing Date won’t be entered into the Summer Raffle 2024.

12. The Draw

The Summer Raffle 2024 Draw will take place on Monday 16th September 2024 at Riverside House, 2 Watt Road, Salisbury, Wiltshire SP2 7UD.

Raffle Tickets for the Summer Raffle 2024 Draw will be drawn randomly.

The result of the Summer Raffle 2024 Draw is final.

13. The Prizes

The Ticket Holder of the first Raffle Ticket drawn will receive £1,000.

The Ticket Holder of the second Raffle Ticket drawn will receive £100.

The Ticket Holders of the subsequent 3 Raffle Tickets drawn will each receive £50.

14. Payment of Prizes

Winners will be notified within 2 days of the draw.

All Prizes are non-transferable and no alternatives will be provided.

A list of winners of Prizes will be available from 18th September 2024 by visiting our website.

We reserve the right to request proof of identity from any person who claims a Prize.

A person shall not be eligible to receive a Prize if they don’t satisfy the criteria at Clauses 1 and 2.

We reserve the right to withhold or refuse payment of any Prize if we have reasonable grounds to believe that these terms and conditions have been breached in any way.

If a Prize is transferred to a person who is not eligible to receive the Prize, the Prize shall be repayable or returned (as applicable) by that person to us on demand.

By entering the Summer 2024 Raffle, if you win a Prize you agree to us using your first name and home county on our website and other channels to promote any raffles we operate.

15. Unclaimed Prizes

All prizes must be claimed no later than six months from the date of the Draw.

Any Prizes which remain unclaimed after six months from the date of the Draw will be forfeited and donated to Alabaré.

16. Limitation of liability

16a.     Subject to Clause 16c, the liability of us to any Ticket Holder shall be limited to the amount of any Prize(s) which is due to that Ticket Holder.

16b.     Subject to Clause 16c, we shall not be liable:

To any person for our inability to contact you and/or award any prize due to any errors or omissions in the details you provide or your failure to update these details if they change;

For any interest of whatever nature claimed by person in a lost or stolen Raffle Ticket;

Any matter beyond our reasonable control.

16c.     Nothing in these terms and conditions shall exclude or limit our liability for:

Death or personal injury resulting from negligence;

Fraud or fraudulent misrepresentation; or

Any other liability that cannot be excluded or limited by law.

17. Complaints

The Summer Raffle will be run by the Fundraising team. In case of any dispute, the decision of the Chief Executive is final. Complaints or disputes will be first handled by our Fundraising team with a right to appeal to the Independent Betting Arbitration Service (‘IBAS’). IBAS can be contacted via their website, by emailing them or calling 020 7347 5883.

19. Governing law

These terms and conditions are governed by the laws of England.

Subject to your right to use an alternative dispute resolution provider as set out at Clause 17, each party agrees that the courts of England shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with this agreement or its subject matter or formation.
